Employee's written statement

  1. The legal name of the employer company.

    National Web Design
    - a trading name of Adstock Web and Software Services Ltd.

  2. The legal name of the employee.

  3. The date the current employment began.

  4. Any earlier date upon which employment with a previous employer began which is treated as "continuous" with the current employment.

  5. The employee's pay, or how it is calculated, and the intervals at which it will be paid - eg weekly or monthly. Salaries are paid monthly in arrears at the month end. For non-managerial staff the employee's hours of work are 9am - 5:30pm Monday to Friday. Staff are expected to be at their desks and working at 9am and there is no paid "cleaning up (or packing up)  time" at the end of the day - i.e. normal work continues until 5:30. Lunchbreaks and tea/coffee breaks are also included and listed separately. In addition staff may be required to undertake an additional five hours per week training. Overtime conditions are described separately but where urgent work is required or in emergencies overtime may be compulsary. Managerial staff will generally work the standard employees hours, but as with most professional grades there is no allocation for paid overtime.

  6. Entitlement to holidays - including public holidays - and holiday pay. Public holidays are taken to include Bank Holidays (when banks may close for business), common law holidays and holidays by royal announcement. When the Christmas and New Year public holidays fall at a weekend, other week days are declared public holidays. The law in the UK does not entitle workers to paid leave for public holidays but paid public holidays are added to all workers' minimum leave entitlement. Outside those times workers must give notice that they wish to take leave. Notice of at least twice the length of intended leave must be given e.g. two days' notice for one day's leave. If insufficient notice is given we may refuse the request.

  7. Responsiblities and Liabilities
Employees will be accountable and liable for all equipment entrusted to the specific employee issued with  e.g. loss of mobile phones, laptops etc.

  8. New employee working overseas
For new employees required to work for abroad for more than a month, this is the mandatory the written statement:

    • Period employed abroad: For UK staff generally the offshore period is 180 days or 6 months normally changing over during the Christmas/New Year Break. For staff from outside the UK asked to work in the UK periods are likely to be variable.
    • The currency in which they will be paid: Generally the currency of the employees original place of employment with National Web Design unless otherwise specifically agreed in writing.
    • Any additional benefits provided because of employment abroad: Pay will be exactly the same regardless of the location. However local transport, food and accomodation will be paid for the first seven days (extendible to fourteen). A cost of living allowance and related success bonus may also be applied where working in areas with a significantly higher cost of living.
    • Terms relating to their return to the UK: We will provide return air tickets to the offshore location and pay the standard fees relating to Visas and Innoculations although it will be the employees responsiblity to obtain  Visas and Innoculations.

  9. Pension. All employment packages (except contractors packages) will be entitled to a generous company (occupational) pension scheme offered in full compliance with best practices outline by the Pensions Advisory Service

Implied terms of an employment contract:  As well as the terms you actually agree with your employee, an employment contract can include implied terms. Implied terms include: the duty of the employer to provide a secure, safe and healthy environment (within the bounds of local conditions) for employees; the employee's duty of honesty and loyal service; an implied duty of mutual trust and confidence between you and your employees that neither side will act in such a way as to breach that trust; a term too obvious to need stating, eg that your employee will not steal from you; any terms that are necessary to make the contract workable, eg that someone employed as a driver will have a valid passport, visas, UK and where working abroad international driving licence.
