      National Web Design's PowerWeb web site solution is a web content management system (also known as a CMS or database web site) based on the proven and extremely powerful Joomla!/Mambo family of database driven web site development and maintainance systems. It is based on a very high performance Content Management System (CMS) which differs from website builders like FrontPage or Dreamweaver in that a CMS allows non-technical users to make changes to an existing website with little or no training through a word processor-like interface.

      Website building tools like FrontPage and Dreamweaver require more technical knowledge and training and allow the user to damage or delete large parts of their own site by accident more easily. In contrast our PowerWeb CMS is an easy-to-use tool that gives authorized users the ability to manage a website. The software manages content (text, graphics, links, etc.) for distribution on a web server. The server based PowerWeb software provides tools where users with little or no knowledge of programming languages and markup languages (such as HTML) can create and manage content and pictures with relative ease of use. PowerWeb  uses a database to hold content, and a presentation layer displays the content to regular website visitors based on the layout that we set up for you. Management of the software is done through a web browser and can be done anywhere there is an Internet connection.

      Your access to your PowerWeb site is essentially a website maintenance tool rather than a website creation tool. We will still do the hard parts of creating the web site for you. Having said that, you can still add extra sections and caegories to your site, extra menu items and as many pages and pictures as you like.

      We configure the CMS to work hand-in-hand to improve not only the number of visitors to your site (hits) but also the conversion rate (sales). The PowerWeb Content management system used is a customized derivative of Joomla/Mambo and is extremely fast at delivering pages (due to features such as page caching) and is optimized to index effectively in search engines. It allows highly cost effective construction of cutting edge sites with RSS feeds, printable versions of pages, news flashes, blogs, forums, polls, calendars, website searching, e-commerce and language internationalization. This proposal is based on a time block of 72 hours to set up the site, and add and customize site graphics, text and design as required. If you like some of this time can be allocated to custom artwork designed specifically for your company by our off-site designer and based on your choice of: own ideas and vision, our designer's interpretations of your vision or those you find inspirational on-line, in print or in the media. We can also match existing artwork.  PowerWeb sites contain state of the art search engine optimization systems which create all the important search engine optimization methods within the site - for example permanent static links, alt tags and a full range of tags and metatags. The powerWeb package is supplemented by training on a one-to-one basis or in small groups and excellent training support material.


      Option 1b: A Shop-in-a-box eCommerce Site without PowerSearch SEO or Web Marketing

      Shop-in-a-box is based on osCommerce whose robust features far surpass nearly all commercial applications on the market today. Although osCommerce can be set up very quickly in its basic form for serious commercial use our normal Shop-in-a-box installation with all upgrades and testing, customization, site structuring population and testing takes a highly experienced team about two person weeks.

    2. Option 2: A PowerWeb Content managed Site or Shop-in-a-box eCommerce Site with the addition of PowerSearch SEO and Web Marketing
      PowerWeb sites contain state of the art search engine optimization systmes which create all the important search engine optimization methods within the site - for example permanent static links, alt tags and a full range of tags and metatags but to reach the top of Google, Yahoo or MSN/Live substantial amounts of work needs to be done outside the actual site. This option, option 2 therefore goes beyond option 1 by adding a comprehensive state of the art Search Engine Optimization and Marketing package to the already highly optimized PowerWeb web site. Unless the client has a clear source of other leads to their web site (e.g. through national television or magazine advertising or a major telesales campaign) then this combination is our recommended option.

      The Web Marketing and Search Engine Optimization (SEO) in PowerSearch comes in two distinct phases. We do this to determine the most effective (and cost-effective) web site, web marketing and SEO activities for your business.

      With web marketing we work mainly through the search results on the main seach engines, generally starting with Google which respesents more that 80% of the new business to available and then extendeding to Yahoo, MSN/Live and so forth. In all these search engines the search results are divided between organic results based on the search engine's perception of the importance and relevance of your site, and pay per click (PPC) results placed near search results; when a site visitor clicks on the advertisement, the advertiser is charged a small amount. What you pay for these - particularly with Google - depends on how many people click and what other advertisers are paying and varies between a few pence and a few pounds per click (i.e. per visitor). Typically 1% of searchers will click through on a normal, intelligently prepared Google ad. If the proportion decreases below 0.5% Google significantly increases the cost per click. However, by increasing your click-through rate to above average your cost per click for a given position on the page will decrease in proportion to your click through rate. The structure and content of your web site also afffect your costs with Google. We can often get your ad budget down to a tenth of what it would cost you yourself - or for the same budget get you ten times the traffic. More importantly we can also use the deatailed information from Google to find out which 'search terms' bring in the best customers. Our procews therefore works in two stages and you as the client can choose how to prioritize them (we'll advise).

      1. The first to take effect is pay-per-click. While it is possible to set up a Google AdWords pay-per-click campaign in a few minutes doing it properly, reseraching keywords with our special software, setting up hundreds (or sometimes thousands) of tightly focused adverts takes 18 hours of work spread over  5-10 days to set up correctly. Changes generally take effect immediately once we have set them up.

        We do this in order to determine the most effective (and cost-effective) web site, web marketing and SEO activities for your business.  We investigate and research a number of things in te process, including what you aim to achieve over all, what sort of people you want to attract and what you expect them to be looking for, what people are actually typing in to Google, current web marketing activities of other organizations in your field, short and long-term strategies for effectively out-competing other organizations in the pay-per-click listings, attracting the people you want and not the people you don't want. Typically this will save you thousands of pounds of advertizing budget over the life of your business.

      2. When we understand the most effective parts of your market we follow this with full seach engine optimizations (SEO) for natural search engine listings may take around 6 months to take their full effect.

        Gaining suitable new prospects from people searching online and visiting the web site is not trivial but is achievable using National Web Design's methods. These combine sophisticated web marketing campaigns, site design, structure and content to cause target customers both to click through to the site and then to make contact with the client. The National Web Design approach typically reduces the cost of acquiring a visitor significantly, improves the quality of visitors, and increases the proportion of visitors that make contact with the client, so as to provide a cost-effective means of gaining suitable new prospects who are looking for something the client can provide, rather than an ineffective or loss-making web site and campaigns. We will draw on what you tell us from your own expertise in your field, on our web site and web marketing expertise, on the findings of our research, including what we find from our research into your competitors' web sites and web marketing activities, and on the use of our special software tools.

        Full implementation of PowerSearch may therefore include SEO work in and outside the site itself, and/or pay-per-click campaign set-up, management, analysis and reporting, ensuring that your pay-per-click ad budget is always being spent in the best way our experts can achieve, in accordance with the latest information that we have on Google strategies and rules, to bring you the customers you want.  The advantage of search engine advertising and marketing is that prospects are presented with your advert exactly when they have a specific need and are looking for solutions.
                   
        This is the first major benefit that we will aim to achieve - reducing your cost per click relative to your rivals. After our process click through rates can be as high as 10%, increasing the number of visitors to your site without significantly increasing your cost.

        Beyond that we will identify keywords which represent a very good return on investment. To do that we will review statistics for advertisers bidding on the same keyword (Advertiser Competition), as well as user searches for that keyword on Google (Search Volume). We will also review the predicted status, average cost-per-click, ad position, and search volume values for ads appearing for your keywords.

        We will also structure campaigns to increase the conversion rate between clicks and sales. Typically this is also 1% and can be raised to as high as 10%, hugely increasing the ROI of AdWord campaigns.

        If appropriate we will investigate and set up MSN and Yahoo CPC campaigns in parallel with the AdWords campaigns.

        Finally, if appropriate, we will analyze successful campaigns and work towards optimizing and developing the site to generate sales through the organic ('free') search engine listings so as to generate an alternative stream of Internet traffic which is not dependent on CPC or AdWord traffic.


  5. Timing: Projects are generally allocated a specific team and block (or blocks) of time for execution, taking into account your timing requirements, when you have said you can provide anything necessary to us, how quickly you have said you can answer any questions from us during the project, and our teams' pre-existing work schedules. Based on these, the following is a realistic schedule:

General Terms and Conditions

  1. National Web Design 90 day Guarantee
    National Web Design guarantees that any coding errors or errors added to supplied materials (e.g. typos) will be corrected free of charge during the first 90 days of site or software operation. We will start to address critical errors immediately we are told about them within normal working hours. Critical errors are ones stopping the site or system from working in some way. We will start to address non-critical errors in less than one working week. This guarantee applies to existing work and is not an offer to add new features to a solution after delivery. This guarantee also applies to updates and amendments added by National Web Design. The guarantee is void if the client or any third party has changed any part of the site or code as we can no longer be certain of functionality of code or veracity of text. In certain circumstances National Web Design can roll back existing web sites or solutions to the original installation condition for a roll-back charge of 20% at which point they are once again are covered by our 90 day Guarantee.

  2. Timing of National Web Design Projects
    Projects are generally allocated a specific team and block (or blocks) of time for execution. There is generally a very high demand on expert staff time, who will have had work scheduled to leave the period of the project planning and system architecture clear, as well as technical staff time who again will have work scheduled to leave time for work on your project. If allocated planning time is spent waiting for essential information or other materials from the client, or preparing material which then cannot be used due to the client not providing other required materials on time, then this will be accruing cost to the company exactly as if the work was able to progress as scheduled, and in cases where it affects the work flow, time wasted will be deducted from the amount of time indicated in the proposal.  Likewise if implementation work is delayed due to the client or his service providers causing the project to fall outside its allocated period, time wasted will be deducted from the amount of time indicated in the proposal.
    At the project start the client will provide all materials the client wishes to have taken into account in any research and planning or used in implementation (e.g. current product details for online shops or web marketing campaigns designed to bring in qualified leads, a valid credit card number and authorization to use it up to a certain amount for pay-per-click adverts, authorization to set up pay-per-click accounts and campaigns for testing and research purposes where applicable, text or images to be used, etc.). During the project the client will provide feedback or responses to questions within 1 working day unless a different response time is agreed above.
  3. Professional Indemnity for National Web Design projects
    In addition to our in-house practices and reputation National Web Design and Software services offer you the additional assurance that our work is covered by Hiscox Professional Indemnity (PI) insurance (Policy reference: 1364062).
  4. National Web Design Service-level agreement (SLA)
    All work is covered by our 90 day warranty as indicated. Unless otherwise indicated fees are for the work outlined in the proposal and no other work. In particular fees do not include upgrades and changes from specification. Free software upgrades including patches and bug fixes will be provided for server software. All upgrades including custom and bespoke software upgrades will be made at standard hourly rates if requested. Hosting contracts include preventative maintenance and remote monitoring and diagnosis of system problems. On site service calls and telephone support falling outside the warranty are chargeable at standard rates. Telephone enquiries during business hours will generally be logged for action immediately. We will make best efforts to address mission critical issues (i.e. ones that stop the operation of your system) immediately. Non mission critical issues will be queued for fair treatment with other clients' projects.
    None of the software or the products provided pursuant to this Agreement is designed or intended to be fault-tolerant or designed or intended for use as or for use where their failure or malfunction could lead to death, personal injury, or economic, physical or environmental damage ("High Risk Activities").  The term "High Risk Activities" includes but is not limited to on-line control equipment in hazardous environments requiring fail-safe performance (such as in the operation of nuclear facilities, aircraft navigation or communications systems, air traffic control, direct life support machines, weapons systems, banking or financial control or reporting systems, or security systems). The Customer warrants that it will not use, distribute or resell any of the products or the software for any High Risk Activities and that it will ensure that permitted end-users of such products or software are provided with a notice in the form set out in this Clause.  The Customer will indemnify National Web Design for any loss, cost, damage or third party claim arising from the Customer's use of any of the products in High Risk Activities or from any breach by the Customer of this clause.
  5. Non-exclusive Agreement with National Web Design
    The Customer acknowledges that National Web Design is providing services to the customer on a non-exclusive basis and that National Web Design may provide services of the same or a similar nature as these services to any other party.
  6. Termination
    1. This Agreement may be terminated in the following circumstances:
    2. By either party by giving the other party thirty (30) days notice in writing to that effect;
    3. Immediately by National Web Design by notice in writing if the Customer fails to remedy a breach of this Agreement (including any provision as to payment) within fourteen (14) days of receipt of a notice from National Web Design of such breach requiring it to do so; or
    4. By either party immediately by notice in writing if the other party takes any corporate action or other steps are taken or legal proceedings are started (and are not withdrawn, discontinued or struck out within twenty-one days) for its winding up, liquidation or dissolution (other than for the purposes of reconstruction) or the appointment of an administrator, receiver, receiver and manager, official manager, liquidator, provisional liquidator, trustee or similar office of it or of any or all of its revenues and assets ("Insolvency Event"), and such Insolvency Event remains in existence in respect of such party as the time of service of the Notice.
    5. Any notice required or contemplated by this Agreement shall be deemed to have been duly given if it is in writing, properly addressed and delivered personally or mailed by recorded delivery or other recognized delivery service giving proof of delivery or by fax or electronic mail to the Customer or National Web Design at the address set out in the proposal or such other address nominated by a party in writing.
    6. The Customer may not assign any of its obligations under this Agreement without the prior written consent of National Web Design  National Web Design may arrange for subcontractors to perform any of National Web Design and Software Services Ltd's obligations under this Agreement.
    7. National Web Design will not be liable to the Customer or to any third party for any non-performance or delay in the performance of its obligations under this Agreement, if events or conditions beyond its reasonable control cause the non-performance or delay and National Web Design gives the Customer prompt notice thereof.  In no event will this provision affect Customer's obligation to make payments to National Web Design under this Agreement except in respect of services that are unable to be performed by National Web Design and Software Services Ltd, until they can be performed.
    8. A failure, delay, relaxation or indulgence by either Party in exercising any right, power or privilege conferred on the Party by this Agreement shall not operate as a waiver of the power or right. A single or partial exercise of any right, power or privilege hereunder does not preclude the further exercise of the same right or the exercise of any other right hereunder. A waiver of a breach does not operate as a waiver of any other breach.
    9. The Customer's obligations (including any obligations to indemnify) shall survive the termination of this Agreement for whatever reason.

      On termination of this Agreement however occurring, all moneys unpaid by the Customer pursuant to this Agreement will immediately become due and payable.  No refunds will be given on unexpired time block(s).
  7. No Poaching
    The Customer undertakes to National Web Design that it will not for a period of two years from the termination of this Agreement entice away or endeavor to entice away from National Web Design any employee of National Web Design  The Customer acknowledges that the prohibition and restriction contained in this clause are reasonable in the circumstances and necessary to protect the business of National Web Design
  8. Hosting
    The following terms and conditions apply to the Hosting services:
    1. Payment: If charges relating to bandwidth are outstanding for a period greater than 5 working days, your service will be suspended.
    2. Hosting Service level agreement: The service provider aims to deliver the highest possible levels of up-time. However the 99.9% uptime guarantee does not include scheduled maintenance - normally conducted outside of working hours. If we can't fulfill this service level agreement, any compensation will be limited to the total fees that you have prepaid, excluding setup fees and the service provider will refund no more than your monthly service fee. By signing up for any of our services you agree to be bound by all the hosting provider terms and conditions.
    3. Sites must not contain Warez, copyright or other illegal material. The onus is on you the customer to prove that you own the rights to publish material, not for the hosting provider to prove that you do not.
    4. Sites must not contain pornographic or other lewd material. Adult Material includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of the hosting providers.
    5. Sites on shared hosting must not use excessive amounts of server resources. These include bandwidth, processor utilization and / or disk space.
    6. Shared hosting sites must not contain scripts that attempt to access privileged server resources, or other sites on the same server.
  9. Payment Terms

      Where the 7.5% prompt settlement discount is not used, payments are due within 30 days and after that are late payments. National Web Design structures Late Payment Terms under the Late Payment of Commercial Debts (Interest) Act 1998 and Late Payment of Commercial Debts Regulations 2002 (SI 2002 No 1674).  These are structured as 8% over base rate of interest, plus an additional fixed penalty charge equal to two standard working days of eight hours each for each of two National Web Design staff at rates current at the time of contract commencement where legal action is taken to secure payment, or equal to one half of one standard working day of eight hours at rates current at the time of contract commencement if payment is made before legal action (including submission through Her Majesty's Courts Service MCOL) has commenced.
    2. Revisions and Changes
      Fees are quoted for specific work defined in the proposal under the option selected and are based on a time basis. Fees do not include any revisions or upgrades which are chargeable separately. Additional work is chargeable on an hourly or daily basis. Estimates are made on an hourly or daily basis.
    3. Ownership of Intellectual Property and Domain Names
      Domains registered by National Web Design for your company become your full property immediately you pay your registration fee to us. They remain yours to use or transfer as you wish for as long as you have registered them. Once we build a site for you and you pay you can take that site with you to another company if you want. You have full copyright on any logos specifically designed for you by us. You retain copyright for all material supplied under the Copyright, Designs and Patents Act 1988 (the Act) and the provisions of the EU Directive on Copyright and Related Rights in the Information Society (EU Copyright Directive) 2001. You are also fully responsible for any copyright violations in material that you provide and any expenses incurred if such violations occur or are alleged to occur. Unless specifically indicated in writing we retain copyright to any source code developed except software developed under the terms of the General Public License, dual-licensing etc. This allows cost reductions by sharing code between applications and incorporating or using code under the General Public License, dual-licensing etc as required. Under our terms National Web Design licenses software and scripts to you for use on your web site in perpetuity without further licensing fees for use unless specifically indicated in this document.
    4. The Customer must not de-compile, disassemble, decrypt, extract or otherwise reverse engineer any part of any software that is provided to the Customer by National Web Design without National Web Design and Software Services Ltd's prior written consent. The Customer must hold any software (in source and/or in object code) and other materials provided to the Customer by National Web Design confidential.  The Customer must not disclose any of those materials to any third party without National Web Design and Software Services Ltd's prior written consent.  The Customer must also take all reasonable steps within its power to protect the Intellectual Property of National Web Design
  10. Liability
    1. Except for express undertakings to indemnify and any warranties set out in these terms:
      1. To the extent permitted by the law, National Web Design expressly excludes all conditions and warranties whether express or implied unless conditions are agreed in a separate document signed by the directors of National Web Design
      2. Notwithstanding any other provision in this Agreement, in no event will National Web Design be liable to any party including the Customer for any indirect, punitive, special, incidental or consequential damage in connection with or arising out of this Agreement (including for loss of profits, use, data, or other economic advantage), however it arises, whether for breach of this Agreement or in tort, and even if National Web Design has been previously advised of the possibility of such damage.  Further, liability for such damages shall be excluded, even if inclusive remedies provided hereunder fail their essential purpose.  The Customer will indemnify National Web Design and keep it indemnified from and against any claims by any third party for or in respect of such damages.
      3. Unless specifically agreed that National Web Design is to provide a back-up service, the Customer is solely responsible for the proper backup and protection of all of its software and data.

Q. I am a little ignorant of www things and today received a letter from "Domain Registry of America" advising that my domain registry of myname.com expires on 12th Sept 2007. The letter is like a proforma payment request asking for either £18, 30 or 50 to cover 1,2 or 5 years respectively. Is this normal and are they legitimate? - They state that I could renew online at their www site = www.droa.com.

 

A. I'm afraid that its an illegal scam , and the US Federal Trade Commission (FTC) have already requested that the appropriate federal district court instruct the Internet domain name reseller "Domain Registry of America" from making misrepresentations in the marketing of its domain name registration services.

They are, in fact, simply a reseller who use the following ICANN accredited registrars: eNom Inc. (eNom.com) and Brandon Gray Internet Services, Inc. (NameJuice.com). They obtain your contact information through the publicly accessible WHOIS database, and send renewal notices through regular mail in an envelope and on stationary intentionally designed to look like an official renewal notice.

If you do remit any payments to "Domain Registry of Canada"/"Domain Registry of America" or "Domain Update Center" and "Domain Listing Center Inc" in order to renew your domain not only will they have defrauded you to get your money, but they may also get control of your domain if they persuade you to sign it over. If you have already made a payment to this company, you should contact your bank or credit card company and ask for the payment to be stopped or reversed. Your credit card may also be compromised.

Another similar situation exists with "EU Registry Services" - Cambridge -  a company calling itself "EU Registry Services" is sending out letters regarding domain names with upcoming renewals. The letters are entitled "DOMAIN EXPIRATION NOTICE" and have a tear-off slip at the bottom for you to detach and send with your cheque. The "EU Registry Services" have already received attention from the Advertising Standards Authority regarding a misleading claim over .eu domains. but the UK police can only take direct action where material falls within their local jurisdiction and the only specialist centre that we are currently aware of if the  Metropolitan Police Service Computer Crime Unit which only covers Greater London - so UK based companies are more of a happy hunting ground for scammers.

Over a period of half a century the Belgian author Hergé is known for developing a more mature appreciation of foriegn cultures starting with his positive typecasting in "Tinitin in Tibet" (I wondered if anyone know Hergé's works are available in China?). Key responsibilities and accountabilities:

  1. To dress, behave and present yourself at all times in the highest professional manner where you might be associated with National Web Design. We've found that our target clients appreciate consistent professionalism at all levels and the National Web Design business dress idiom is formal - similar to that worn by a lawyer or accountant rather than more liberal or modern interpretations. 
  2. Repond immediately to incoming meeting requests from qualified leads and other client communications. The longest period that any prospect or client should wait is the end of the same working day for communications recieved before 17:00 or 09:30 on the next working day for communications received after 17:00
  3. To lead and present at sales meetings with clients decision makers made by the National Web Design sales and marketing teams or coming in directly from direct enquiries, referals or repeat enquires to National Web Design.
  4. To research each client to be met (using the internet) so that their specific needs can be dicussed in a credible and informed way from the very beginning.
  5. To co-ordinate with National Web Design sales and marketing teams who arrange meetings at suitable times and suitable geographic locations e.g. arranging so that all meeting in a particular geographic location occur on the same day with suitble time to travel between them.
